Terms of Service

These Terms of Service ("Terms") govern your use of TradieAus, a business management platform operated by Murphys Technology Pty Ltd (ABN 97 628 755 055) ("we", "us", "our"). By creating an account or using TradieAus, you agree to these Terms.

1. Eligibility

TradieAus is designed for Australian trade businesses and sole traders. You must be at least 18 years old and hold a valid ABN to create an account. You are responsible for maintaining the confidentiality of your login credentials.

2. Account Registration

When you register, you agree to provide accurate and complete information including your business name, ABN, email, and phone number. You are responsible for all activity that occurs under your account.

3. Free Trial

New accounts receive a 2-day free trial with access to all features. No credit card is required for the trial. After the trial period, you must subscribe to continue using the platform.

4. Subscription and Payment

TradieAus Pro is $26 AUD per month, billed monthly via PayPal.
Subscriptions auto-renew each month until cancelled.
You can cancel your subscription at any time from your PayPal account under Subscriptions.
No refunds are provided for partial months. Upon cancellation, you retain access until the end of your current billing period.
We reserve the right to change pricing with 30 days notice to existing subscribers.

5. Acceptable Use

You agree not to:

Use TradieAus for any unlawful purpose
Share your account credentials with others
Attempt to access other users' data
Use automated tools or bots to create accounts or access the platform
Upload malicious files or content
Reverse engineer, decompile, or attempt to extract the source code
Send spam, phishing, or unsolicited communications through the platform

6. Your Data

You retain ownership of all data you enter into TradieAus, including client details, quotes, invoices, jobs, compliance documents, and uploaded photos. We do not claim any intellectual property rights over your data. See our Privacy Policy for details on how we handle your information.

7. AI-Generated Content

TradieAus includes AI-powered features such as quote generation and a help chatbot. AI-generated quotes are estimates based on publicly available Australian trade pricing data and should be reviewed and adjusted before sending to clients. We do not guarantee the accuracy of AI-generated pricing. You are solely responsible for the quotes and invoices you send.

8. Email and SMS Services

TradieAus sends transactional emails and SMS messages on your behalf (quotes, invoices, review requests, notifications). By using these features, you confirm that you have appropriate consent from the recipients. You must comply with the Australian Spam Act 2003 and the Do Not Call Register Act 2006.

9. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance with reasonable notice. We are not liable for any losses arising from service interruptions, including those caused by third-party providers (Supabase, Resend, PayPal, etc.).

10. Limitation of Liability

To the maximum extent permitted by Australian Consumer Law:

TradieAus is provided "as is" without warranties of any kind.
We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform.
Our total liability is limited to the amount you have paid us in the 12 months preceding the claim.
We are not responsible for the accuracy of data you enter, quotes you send, or business decisions you make based on the platform.

11. Account Termination

We may suspend or terminate your account if you violate these Terms, fail to pay your subscription, or engage in abusive behaviour. You may delete your account at any time from Business Settings. Upon deletion, all your data is permanently removed within 30 days.

12. Intellectual Property

TradieAus, including its design, code, features, and branding, is the intellectual property of Murphys Technology Pty Ltd. You may not copy, modify, distribute, or create derivative works based on the platform without our written permission.

13. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales. Nothing in these Terms excludes or limits your rights under the Australian Consumer Law.

14. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes via email at least 14 days before they take effect. Continued use of TradieAus after changes constitutes acceptance of the updated Terms.
